Non-discrimination Statement

The California Table Grape Commission prohibits discrimination in all its programs and activities on the basis of race, color, national origin, age, disability and where applicable sex, marital status, familial status, parental status, or religion. (Not all bases apply to all programs.) Persons with disabilities who require alternative means for communication of program information (Braille, large print, audiotape, etc.) should contact the commission at 559.447.8350. Additionally, program information may be made available in languages other than English.

Accessibility Statement

As outlined below, the commission is making every effort to ensure that the pages on this website are accessible to individuals with disabilities in accordance with Section 508 of the Rehabilitation Act as amended.

The commission’s commitment takes several concrete forms:

  • Provide text equivalents for every non-text element including image maps, GIFs, JPEGs and other format images.

The commission site contains information including complex tables. We are working hard to ensure that the web site is completely accessible but recognize that there may be remaining issues. Terms of Use

Materials on this site are for use in conjunction with California Table Grapes only. Use of the site implies acceptance of the terms of use. The information and material are not authorized for use to promote grapes from origins other than California.

1. Modification The commission may change this Agreement from time to time by notifying users of such changes by any reasonable means, including by posting a revised Agreement through the site.

2. Jurisdiction The site is controlled or operated (or both) from the United States, and is not intended to subject the commission to any non-U.S. jurisdiction or law. The site may not be appropriate or available for use in some non-U.S. jurisdictions. Use of the site is at one’s own risk, and users must comply with all applicable laws, rules and regulations in doing so. The commission may limit the site availability at any time, in whole or in part, to any person, geographic area or jurisdiction.

3. Rules of Conduct In connection with the site, users will not:
a. Post, transmit or otherwise make available through or in connection with the site any materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others; (b) defamatory, libelous, fraudulent or otherwise tortious; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.
b. Use the site or its contents for any purpose that is fraudulent or otherwise tortious or unlawful.
c. Harvest or collect information about users of the site.
d. Remove any copyright, trademark or other proprietary rights notice from the site.
e. Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or otherwise gather site content, or reproduce or circumvent the navigational structure or presentation of the site, without the commission’s express prior written consent. Notwithstanding the foregoing, and subject to compliance with any instructions posted in the robots.txt file located in the site’s root directory, the commission grants to the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of (and solely to the extent necessary for) creating publicly available, searchable indices of such materials, but not caches or archives of such materials. the commission reserves the right to revoke such permission either generally or in specific cases, at any time and without notice.

4. Proprietary Rights The site is protected by proprietary rights and laws. The California table grape trade names, trademarks and service marks include Grapes from California, the Natural Snack, Go with Grapes, and any associated logos.

5. Third Party Sites The site may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of this site and this site is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. This site is not responsible for webcasting or any other form of transmission received from any Linked Site. The commission is providing these links only as a convenience, and the inclusion of any link does not imply endorsement by the commission of the site or any association with its operators.

6. Registration; User Names and Passwords Registration, which is limited to California table grape growers or shippers, is required for a portion of the site. Access is specific to an email address and that login information should be kept confidential. Please notify the commission via [email protected] of any confidentiality breach or unauthorized use of your user name or password.

7. Disclaimer of Warranties To the fullest extent permitted under applicable law: (a) the site and any Products and Third Party Materials are made available on an “As Is,” “Where Is” and “Where Available” basis, without any warranties of any kind, whether express, implied or statutory; and (b) the commission disclaims all warranties with respect to the site and any products and third party materials, including the warranties of merchantability, fitness for a particular purpose, non-infringement and title. All disclaimers of any kind (including in this section and elsewhere in this Agreement) are made for the benefit of both the commission and its affiliates and their respective shareholders, directors, officers, employees, affiliates, agents, representatives, licensors, suppliers and service providers (collectively, the “Affiliated Entities”), and their respective successors and assigns.

The commission does not guarantee that the site is or will remain updated, complete, correct or secure, or that access to the site will be uninterrupted. The site may include inaccuracies, errors and materials that violate or conflict with this Agreement. Additionally, third parties may make unauthorized alterations to the site. If you become aware of any such alteration, contact us at [email protected] with a description of such alteration and its location on the site.

8. Limitation of Liability The commission will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages of any kind, under any contract, tort (including negligence), strict liability or other theory, including damages for loss of profits, use or data, loss of other intangibles, loss of security of Submissions (including unauthorized interception by third parties of any submissions), even if advised in advance of the possibility of such damages or losses;

9. Indemnity To the fullest extent permitted under applicable law, users agree to defend, indemnify and hold harmless the commission and the Affiliated Entities, and their respective successors and assigns, from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses and fees (including attorneys’ fees) arising out of or relating to (a) the use of, or activities in connection with, the site (including all Submissions); and (b) any violation or alleged violation of this Agreement by a user.

10. Termination This Agreement is effective until terminated. The Commission may discontinue or modify and features, functions, content, etc. of the site at any time in its sole discretion. The commission may terminate or suspend use of the site at any time and without prior notice, for any or no reason, including if the commission believes that you have violated or acted inconsistently with the letter or spirit of this Agreement.

11. Governing Law; Arbitration The terms of this Agreement are governed by the laws of the United States (including federal arbitration law) and the State of California, U.S.A., without regard to its principles of conflicts of law, and regardless of a user’s location. Except for disputes that qualify for small claims court, all disputes arising out of or related to this Agreement or any aspect of the relationship between you and the commission, will be resolved through final and binding arbitration before a neutral arbitrator instead of in a court by a judge or jury. Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.

12. Miscellaneous The headings herein are for convenience only and shall not be used to interpret this Agreement. This Agreement shall not be strictly construed against any party hereto. Invalidation of any of the provisions of this Agreement shall in no way affect any of the other provisions hereof, or the application thereof to any other person or entity and such other provisions shall remain in full force and effect. This Agreement shall be interpreted and enforced pursuant to the laws of the State of California, without regard to its choice of law rules.

ABOUT California TABLE GRAPES

Californians have been cultivating grapes for more than two centuries. Today, 99 percent of U.S. table grapes are produced in California's warm, dry climate that is ideal for grape growing. With more than 90 grape varieties grown, California grapes come in three colors—green, red and black—and are in season from May through January.
